Terms of Service

This agreement sets out the rights, obligations and rules of use between you and the platform ' s operators when you register, log in and use statistical services on the Tuleer website.

Please read this agreement carefully before registration, in particular with regard to account security, data compliance, service restrictions and liability boundaries. Checking out consent and completion of registration, or the actual use of services, means that you have read, understood and agreed to be bound by this Agreement.

1. Scope and definitions

This agreement, which you and the Tuleer operator have established, applies to the Tuleer network, the user console, the statistical script, the pick-up interface and the related functions provided by the platform.

  • The term “platform” or “we” refers to Tuleer and its legitimate operator.
  • “Users” or “you” means natural persons, legal persons or other organizations that register accounts, create websites or use statistical services.
  • “Statistical website” means a website, web page or other authorized web service created by a user and accessed by a statistical code.
  • “visiting data” refers to access, equipment, sources and event data generated by statistical scripts on statistical websites and sent to the Platform.

2. Account registration and security

  • You should provide real, accurate, complete and valid and continuous registration information and ensure that the mailbox used for registration is legally controlled by you.
  • You shall keep the accounts, passwords and login in good condition and shall not lend, rent, transfer or share the accounts with persons not entitled to them.
  • Operations occurring under an account are, in principle, regarded as acts of the account holder. When an account is discovered to be abnormal, documented or unauthorized, the password should be changed immediately and we should be contacted.
  • The platform can prevent automated registration, collisions and other abuses by means of security validation, access frequency limits and risk identification.
  • Minors under the age of 14 shall not register themselves; if necessary, this agreement and privacy policy shall be read by the guardian.

3. Service description

The platform provides access to website data collection, real-time visitors, page analysis, source analysis, equipment analysis, target and custom events, multi-site management, etc. Specific capabilities, data retention periods, usage and entitlements are based on the description of the current package and the presentation of the console.

In order to ensure the quality and safety of service, the platform may perform maintenance, upgrades, capacity adjustments or functional optimizations and, to a reasonable extent, notify users by means of station announcements, page tips or registered mailboxes.

4. User responsibilities and website compliance

  • You confirm that you have or have been fully authorized the ownership, management or authority to install statistical codes on a statistical website and process the resulting data.
  • Visitors to the website shall be provided with clear and comprehensible privacy information, in accordance with applicable law, and valid consent if required by law.
  • You should correctly configure the domain name of the website, the permitted source, the name of the event and the self-defined attributes, and not upload sensitive personal information, such as passwords, payment certificates, identity documents, precise location, medical information, through a custom event.
  • You should respond to legal requests for queries, corrections, deletions, withdrawals of consent from visitors to statistical websites; where assistance from the Platform is required, verifiable processing requests can be submitted through support channels.
  • You shall be free to ensure that the content, operations, data sources and statistical purposes of the website are legitimate and do not infringe on the legitimate interests of any third party.

5. Prohibited conduct

When using services, no person shall be allowed to commit or assist in:

  • Access to unauthorized websites for the illegal collection, sale, provision or disclosure of data on others;
  • Uploading of illegal content or use of services for fraudulent, harassment, abuse, malicious marketing, etc.;
  • Detection, assault, bypass, interference with platform security measures, bulk registration accounts, falsification of statistical requests or malicious depletion of system resources;
  • (b) In camera procedures for reverse engineering, reproduction, rental, resale of platforms, or competitive hosting services without written permission;
  • Removes a statistical script, a page or a rights label in a document, or misleadingly indicates a relationship of cooperation, authorization or endorsement with the Platform;
  • Laws and regulations prohibit, or may endanger, network security, the public interest and the legitimate interests of others.

6. Plans, fees, and orders

  • The price, billing period, usage, data retention period and functional equity of the free and paid package are determined on the price page or on the order confirmation page.
  • The food package, the amount, the duration and the manner of payment shall be checked before the next order. Services actually consumed are not supported without justification unless otherwise provided by law or expressly committed on the page.
  • Some of the functionality may be limited when the package expires, the amount used is exceeded or the payment fails; after the reasonable retention period has expired, the data may be cleaned up in accordance with policy.
  • In the case of invoices, refunds or transactional objections, the order number and the necessary certification shall be submitted through the support channel, and we shall proceed in accordance with the applicable rules.

7. Data, privacy, and security

You retain the right to be legally uploaded or generated through a statistical website. You authorize the Platform to process these data to the extent necessary to provide, maintain, protect and improve services. We don't use it for third-party advertising without user authorization.

8. Intellectual property

The intellectual property rights of Platform software, interfaces, graphics, logos, documents, statistical scripts and related content are owned by the Platform or the corresponding rights holder. This Agreement does not transfer any intellectual property rights to users except for limited, avoidable and non-exclusive licences obtained for the normal use of services.

Users retain the corresponding rights to the content of their websites, trademarks and legally submitted data and ensure that their use does not violate the rights of third parties.

9. Service changes, interruptions, and maintenance

Internet services may be interrupted for short periods of time by maintenance, upgrading, network failure, upstream service anomalies, force majeure or regulatory requirements. The platform will take reasonable measures to reduce the impact and provide advance notice of significant maintenance where feasible.

We can adjust services on the basis of security, compliance, product evolution or business arrangements, but without undue prejudice to the core interests of users that have been purchased and remain in force for a period of time.

10. Limitation of liability

  • The Platform makes reasonable commercial efforts to safeguard service continuity and data security, but does not promise that services will never be interrupted, that the data will be absolute or applicable for all specific purposes.
  • The user is legally liable for losses caused by the user ' s unlawful access, misconfiguration, disclosure of documents, uploading of sensitive information or violation of this agreement.
  • To the extent permitted by the law, the Platform is not liable for indirect loss, loss of expected benefits or loss resulting from third-party services beyond those provided for by law.
  • No exemption or limitation of liability precludes the law from expressly providing for liability that cannot be excluded or limited.

11. Suspension, termination, and data handling

In the event of a serious breach of this agreement by the user, a breach of the system's security, an infringement of the rights of others or the existence of a legal or regulatory requirement, the Platform may take such measures as warning, restriction of function, suspension or termination of the account, depending on the level of risk, and keep the relevant records.

Users can stop using services and apply for cancellation of accounts. Upon termination of the agreement, the Platform will process the accounts and statistics in accordance with privacy policy, the reserve period of the package and applicable law, except for data required by law to preserve or resolve the dispute.

12. Updates, governing law, and contact

We may update this agreement in the light of legal changes or service adjustments. Major changes will be notified by reasonable means, such as page tips, station announcements or registered mailboxes; updated agreements will become effective from the date indicated.

The law of the People ' s Republic of China shall apply to the conclusion, implementation and interpretation of this Agreement. In the event of a dispute, the parties shall consult amicably; if they fail, they shall be referred to the competent people ' s courts as provided by law.
